SC reserves judgment on legal grounds against Allahabad HC judgment striking down UP Madrasa Act

The Supreme Court on Tuesday (October 22, 2024) reserved its judgment on legal grounds challenging Judgment of Allahabad High Courtwho promulgated the Uttar Pradesh Madrasas Act, 2004 as unconstitutional on the basis that it is violation of the principle of secularism.

A bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Misra heard a panel of lawyers on behalf of eight petitioners besides Additional Solicitor General KM Natraj for the Uttar Pradesh government for nearly two days before to retain the sentence.

Commencing final arguments on the grounds against the verdict, the bench on Monday heard senior advocates including Abhishek Manu Singhvi, Salman Khurshid and Menaka Guruswamy for the petitioners.

On Tuesday, the apex court also heard senior advocates including Mukul Rohatgi, P Chidambaram and Guru Krishna Kumar for various parties in the case.

On March 22, the Allahabad High Court declared the law “unconstitutional” and violative of the principle of secularism and asked the state government to accommodate the madrassa students in formal school system.

On April 5, the CJI-led bench gave a respite to about 17 lakh madrassa students by staying the Supreme Court’s verdict that struck down the Uttar Pradesh Madarsa Board Education Act, 2004.

The high court heard about eight petitions, including the leading one filed by Anjum Kadari against the Supreme Court verdict.
